Terms and Conditions of Sale

1. General

The buyer is responsible for carefully reviewing the terms.

2. Sale in Current Condition, Bidder's Duty to Inspect

All items are used and sold in their current condition. Because items are sold in their current condition, the Bidder has an extensive duty to inspect. In light of this duty, the Bidder should, before the auction, conduct a thorough inspection of the item to assess its condition and quality. Dahlströms Fine Art cannot be held liable if the Bidder neglects their duty to inspect and is not responsible for anything the Bidder could have discovered if they had fulfilled their duty.

3. Item Description

All information about the items for sale, including size, condition, and any defects or flaws, will be provided as detailed as possible in the item description. We strive to provide accurate images of the items, but we cannot guarantee that the color representation is completely accurate due to individual screen settings. The item description represents the current condition of the item at the time of the auction. The buyer is responsible for carefully reviewing all available images and descriptions before placing a bid to ensure they are fully informed about the item's condition and characteristics. Any questions or uncertainties should be clearly communicated to us before buying.

4. Payment

All payments must be made in Swedish kronor (SEK). The buyer is responsible for any currency exchange fees and exchange rate risks. Full payment for purchased items must be received by Dahlströms Fine Art no later than seven calendar days after the last auction day in the auction round in which the item was sold. Accepted payment methods: Visa, MasterCard, AmEx, bank transfer, PayPal, Stripe. Dahlströms Fine Art reserves the right to reject bids from customers who have previously failed to make payments. In such cases, a deposit may be required to accept future bids.

5. Transport

Dahlströms Fine Art assumes that shipments will be sent by post after the auction is completed. If the buyer wishes to collect the item, a discussion regarding transport arrangements is required. The buyer pays for the transport of purchased items from Dahlströms Fine Art's premises to the buyer. Items will not be handed over to the carrier unless they are fully paid for. Dahlströms Fine Art reserves the right to choose the carrier deemed most suitable unless the buyer has previously contacted us and expressly requested another carrier.

6. Collection

Purchased items must be collected no later than seven (7) calendar days after the last auction day in the auction round in which the item was sold. However, purchased items may not be collected before full payment has been received by Dahlströms Fine Art. Collection must take place at Dahlströms Fine Art's premises after agreeing on a booked time for pickup. If an item is not collected within the prescribed time, a storage fee of 50 SEK including VAT (40 SEK excluding VAT) will be charged for each calendar day the item is not collected. Alternatively, Dahlströms Fine Art has the right to send items not collected on time to any forwarding company for storage. In such cases, the buyer is responsible for paying the actual costs charged by the forwarding company. Furthermore, the rules in the Act (1985:982) on a trader's right to sell uncollected goods apply.

7. Right of Withdrawal

According to the law on distance contracts and contracts outside business premises (2005:59), you as a consumer have a right of withdrawal that extends 14 days after you as the buyer have taken possession of the item. This period also counts from when any agent appointed by the buyer has taken possession of the item. This right of withdrawal does not apply to businesses, nor if exceptions from the right of withdrawal in the mentioned law can be applied. If the right of withdrawal is to be invoked, the buyer is responsible for notifying Dahlströms Fine Art before the 14-day withdrawal period has expired. The right of withdrawal is invoked by contacting us via email at info@dahlstromsfineart.se, providing your customer number, item number, and bank details for a refund. The buyer is also responsible for ensuring, at their own expense, that the item is returned to Dahlströms Fine Art. The item must be packaged in such a way that it is returned to the auction house in the same condition as when it was sold. If the item has been damaged during transport or due to the buyer's handling, Dahlströms Fine Art is not obliged to accept the right of withdrawal. Dahlströms Fine Art has the right to close a customer's account if they suspect that the customer is abusing the right of withdrawal to avoid honoring their bids on repeated occasions. It is not permitted to bid on items you have previously won and then invoked the right of withdrawal.

8. Force Majeure

Dahlströms Fine Art is not responsible for any damage caused by circumstances beyond our reasonable control or knowledge, such as changed legislation, government action, currency restrictions, war or terrorist events, pandemic, extreme weather, fire or other accidents, failures in power transmission or telecommunications networks, scarcity of transport, general scarcity of goods, lockouts, strikes, boycotts, and blockades, or other similar circumstances. This applies regardless of whether the circumstance occurs in Sweden or abroad. The reservation regarding strikes, lockouts, boycotts, and blockades also applies if Dahlströms Fine Art itself takes or is subject to such action. To be exempt from liability, the circumstance must hinder or significantly impede Dahlströms Fine Art from fulfilling its obligations on time.

9. Disputes

Any disputes between Dahlströms Fine Art and the buyer regarding the stipulated terms above shall be resolved according to Swedish law and in a Swedish court.

10. Language Versions

These general terms are available in Swedish and English. In case of any discrepancy between these versions, the English version shall prevail.

11. Personal Data and Privacy

Personal data provided to Dahlströms Fine Art by the Bidder is processed by us for administration and fulfillment of our contractual obligations towards the Buyer and other customers, auction activities in general, and to fulfill obligations under the law (e.g., tax laws) or to perform tasks in the public interest (e.g., cultural-historical documentation, including provenance information and investigation of suspected crimes). Personal data provided to Dahlströms Fine Art by the Bidder may also be processed by us for market and customer analysis and statistics, as well as for our own marketing, such as sending newsletters and invitations. For these purposes, such personal data may be shared with third parties, but not beyond what is necessary in each individual case. We do not sell or otherwise share personal data to third parties for third-party marketing. Personal data may also be shared with external shippers to fulfill such tasks as prescribed in these terms, but not beyond what is required in each individual case. Dahlströms Fine Art undertakes to handle personal and business information about the Bidder confidentially and to only disclose such information to third parties in connection with crime investigations or if there is an obligation for other reasons under the law. Confidentiality may be broken to the extent necessary to prevent or combat crime and to safeguard Dahlströms Fine Art's interests in disputes, potential disputes, and other legal proceedings. We also have the right to disclose personal and business information to companies under the supervision of the Swedish Financial Supervisory Authority (or equivalent authority in another country), to the extent that the information is requested (i) as part of the requesting company's work to combat money laundering and financing of terrorism and (ii) will be subject to customary statutory banking secrecy at the requesting company.

Effective Date

These general terms apply to auctions taking place after May 20, 2024.
